Terms of Service & Commission Terms

By joining the list or commissioning a crest, you agree to these terms.

1. Who we are

IM Observer (“we”, “us”), operating imobserver.com. These terms cover both the waitlist and the commissioning of a bespoke crest.

2. The waitlist

Joining the list is free, places you in the queue in the order you joined, and is not a purchase — it creates no obligation to buy. We will contact you with details and the founding price before any public opening.

3. How a Commission works

Invitation, then your brief (you share your car and your story), then confirmation and payment, then the illustration — drawn by hand by one artist over days, not minutes — then delivery: high-resolution digital files, a numbered certificate of authenticity, and a permanent entry in the Observer Archive. Physical prints may be offered as a separate option.

4. The queue and timing

Crests are made by a single artist, only a few each month, in the order people join. We give honest time estimates but do not guarantee exact delivery dates.

5. Pricing and the founding price

The price is shown to you before you order. Founding (early) clients receive a founding price that is lower than the later public price, and that founding price is honoured for the founding group.

6. Revisions and satisfaction

Each commission includes revisions: we refine your crest until you are happy with it, within the scope of your original brief. This is how we make sure you love the result before final delivery.

7. Payment

Payment is taken before the illustration begins. Where a deposit model is used, the remaining balance is due before final files are delivered.

8. Cancellation and refunds

Before illustration begins, you may cancel for a full refund of anything paid. Once illustration has begun, because each crest is custom-made for you, the fee is non-refundable; instead, we keep revising until you are satisfied. Delivered digital files are non-refundable (they are custom digital goods) — the revision process exists precisely so you are happy before final delivery. Physical prints, if ordered, are made to order and non-returnable, except where they arrive damaged or defective, in which case we will replace them. Where mandatory consumer law gives you additional rights, those rights are not affected.

9. Intellectual property and how you may use the crest

Your crest is an original artwork created for you. On full payment you receive the right to use it for personal purposes — prints, wallpapers, profile images, and your personal social media. IM Observer retains authorship of the artwork and the right to show it in its portfolio and the Observer Archive; if you would prefer your crest kept private, tell us and we will honour that. You may not resell the artwork, claim it as your own design, or use it as a commercial logo or brand identity without our written permission.

10. Not affiliated with Porsche AG

IM Observer is independent and is not sponsored, endorsed by, or affiliated with Dr. Ing. h.c. F. Porsche AG. The Porsche name and the Porsche crest are trademarks of Porsche AG; we use the word only to describe the car your artwork celebrates. Your commissioned crest is an original heraldic illustration — it is not the Porsche crest and is not an official Porsche product.

11. Your information

You confirm that the information you give us is accurate and that you have the right to share it with us.

12. Liability

We provide our services with reasonable care and skill. To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.

13. Governing law

These terms are governed by the laws applicable at our principal place of business, and any dispute will first be addressed in good faith between us.
