Who we are
IM Observer is the trading name of Ihor Miliev, Individual Entrepreneur (FOP) registered in Ukraine, tax ID (RNOKPP) 3816909735, business address 1 Shevchenka St., apt. 183, Izmail, Odesa region, 68610, Ukraine, operating imobserver.com. How commissioning works
Order → your brief → payment (by card on the payment page for a single crest, otherwise by invoice) → hand-drawn illustration with your tier's refinement rounds → your approval → delivery of your files, your printed crest (framed with The Chronicle and The Observer), the custom enamel grille badge featuring your crest with The Observer, and your numbered entry in the Observer Archive. One order may cover up to five crests, one per car; each crest is drawn from its own brief and receives its own archive number.
Pricing and payment
Prices are shown on the site before you order and are quoted in US dollars. Prices are $375 for The Seal, $595 for The Chronicle and $895 for The Observer. Where one order covers several crests, the first crest is charged at the tier price and every crest after it at 15% less; the discount is flat and does not deepen with quantity. The prices shown are the price of the commission itself, including the print and its shipping. When you pay by card, the payment page shows any processing fee before you confirm. When you pay by invoice, we agree with you beforehand how you wish to pay; where a payment method carries a processing fee, the amount is agreed with you in that exchange and stated on the invoice, and nothing is added to the invoice afterwards. Add-ons (a grille badge with The Seal or The Chronicle, $395; an interior badge, $295; a custom video, The Drive, $190) are added to your invoice and quoted before you pay for them. Returning customers may be offered a personal discount on request. A commission is a bespoke artistic service performed by hand to your individual brief — it is not an automated or downloadable digital product — and no EU or UK VAT is charged on it. The full fee is payable in advance, by card on the payment page or by invoice (card or bank transfer, and other methods where we can agree them). An unpaid invoice does not hold a place in the queue; there is no penalty and no obligation — ask us and we will reissue it at the price then current. Your queue number is secured the moment payment clears.
Commissions bought as a gift
You may commission a crest for someone else. You remain our customer: you place the order, you pay for it, and every right and obligation in these terms — including the statutory right of withdrawal — is yours, not the recipient's. On full payment the personal, non-commercial licence is granted to the recipient as the owner of the car the crest was drawn for; tell us their name and we record it. Where you ask the recipient to fill the brief, they do so on your behalf and we treat the details they give us as the brief for your commission; we contact them only in the way we agree with you. A date you give us is the date we plan the queue around — we say straight away if we cannot honour it, and never accept an order we do not believe we can deliver in time.
The queue and timing
Crests are made by a single artist, a few each month, in order of payment. Where one order covers several crests, each crest takes its own place in that queue and they are drawn one after another, not at once. Your queue number and an estimated start window are confirmed once your payment clears. If we cannot begin within 21 days after your estimated start window, you may keep your place or receive a full refund. We give honest estimates but do not guarantee exact delivery dates.
Revisions
Each commission includes refinement rounds within the scope of your original brief: The Seal, three rounds; The Chronicle and The Observer, five rounds each. Where one order covers several crests, every crest carries its own rounds. One round is one consolidated set of comments on a presented version. A new creative direction beyond the original brief is quoted as additional work.
Cancellation, refunds and withdrawal
Before illustration begins, you may cancel for a full refund of everything paid. If you are a consumer in the EU or UK you also have a statutory 14-day right of withdrawal: for the service and the digital parts of your commission it runs from the day the contract is concluded (the day your payment clears), and for your print or Framed Edition it runs from the day you receive it. To withdraw, just tell us in a clear statement by email or by post — you may use the model withdrawal form in our Refund policy, but you do not have to. We refund every payment received from you, including standard delivery costs, within 14 days of being informed, using the same means you paid with and at no charge to you. Because you expressly asked us to begin work before the end of that period, if you then withdraw you pay an amount in proportion to what was actually supplied to you by the moment you told us, measured against the full coverage of the contract and calculated on the total price agreed. You also expressly consented to us beginning the supply of your personalised digital content within the period and acknowledged that you thereby lose the right of withdrawal for that content once supply begins. Personalised physical items are made to your specification and are exempt from withdrawal, except when damaged or defective — then we replace them free of charge. Mandatory consumer law rights are not affected.
Intellectual property
Your crest is an original artwork created for you. It is not a work made for hire, and no copyright is transferred to you: IM Observer remains the author and the copyright owner of the crest and of every sketch, draft and vector master behind it. What you receive on full payment is a perpetual, worldwide, non-exclusive, non-transferable licence to use your crest for personal, non-commercial purposes — prints, wallpapers, profile images, your personal social media, and reproduction on vehicles you personally own. Where your commission includes the vector master, you may take it to a workshop of your choice for cutting or fabrication for your own vehicle. You may not use the crest as a trade mark, business name or logo, place it on goods offered for sale, or pass the crest or the vector master to anyone else; ask us in writing and we will quote a commercial extension. Your licence stays with you and does not pass to a buyer of the car — tell us before you sell and we will transfer it to the new owner at no charge. We may engage production partners under sublicence solely to fulfil your order. We show your crest publicly — in the Observer Archive, on our social channels or in our portfolio — only where you gave us that specific opt-in in your brief, and you may withdraw it at any time, after which we remove the public entry.
Your materials and warranties
You warrant that you have the right to provide every material you share — photographs of your car, personal symbols, mottoes, images of people or pets — and that our use of them to create your crest will not infringe third-party rights. We will not include third-party logos, club emblems, characters or official manufacturer marks in a crest, nor anything listed under "What we will not draw". You will reimburse us for any claim, fine or legal cost we incur because a material you supplied, or an element you asked us to include, infringed someone else's rights or broke the law — but only where you knew, or ought reasonably to have known, that it did. This does not limit your rights as a consumer under mandatory law.
Production by third parties
Where your commission includes a vector master for vinyl, cutting and application are performed by a workshop you choose, under your own contract with them. We supply clean, scalable files and a recommended size for your model; we are not responsible for the workmanship, materials or results of third-party fabrication.
Independence
IM Observer is independent and not affiliated with, sponsored or endorsed by Dr. Ing. h.c. F. Porsche AG or any vehicle manufacturer. Manufacturer names are used only to identify a customer’s own car. Your commissioned crest is an original heraldic illustration, not an official product of any manufacturer.
What we will not draw
A crest is a permanent, public mark, and in some countries certain symbols are protected by criminal law — a crest carrying one can expose you, not only us, to seized goods or worse in your own country. So whatever tier you buy, we will not include: any national flag, state emblem, coat of arms or official insignia, or anything closely resembling one; the emblem, name, image or personal cypher of any head of state, ruler or ruling family, or of any government, military, police or judicial body; the Shahada, any Qur'anic verse, any name of God, or any other sacred text in any language or script; any religious symbol; any tribal or clan mark you cannot show a personal right to bear; any registered trade mark, manufacturer badge, club emblem, motorsport livery or fictional character; imagery of alcohol, tobacco, drugs, gambling, nudity, sexual content or violence, or anything that would reasonably be regarded as offensive to a religion or to public morals; and any symbol of a proscribed, extremist or terrorist organisation. If your brief asks for any of these we will say so and propose an alternative; if none can be agreed we cancel and refund you in full. You remain responsible for whether your finished crest may lawfully be displayed, printed, imported or applied to a vehicle where you live — we draw an original illustration and give no warranty on that point.
Our right to decline or cancel
An order placed on this site is an invitation to us, not a binding contract; a contract is formed only when your payment clears — on the card payment page, or against our invoice. Until then we may decline any order without giving reasons. We may also cancel a commission at any time before delivery — where a brief falls outside what we are willing to draw, where we cannot get the information we need from you, where a working relationship has broken down, or where accepting or performing it would breach sanctions, export controls or the rules of our payment providers. If we do, we refund in full everything you have paid for that commission, and that refund is your sole remedy. You confirm you are not subject to sanctions imposed by Ukraine, the European Union, the United Kingdom or the United States.
Shipping, duties and delivery times
Digital files are delivered by email or download link to the address on your order. We will deliver your final digital files no later than 90 days after your payment clears, unless a longer period is stated on your invoice and agreed by you, or unless we are waiting on your response, your materials or your approval; if we miss that date you may cancel for a full refund. Physical items are made to order and shipped from Ukraine by tracked courier within 30 days of your final approval of the artwork. Risk passes to you on delivery to the address you give us, so please make sure it is complete and reachable. Prices cover the commission and standard shipping; they do not include import duty, import VAT, customs clearance or carrier brokerage charges in your own country, which are assessed on you as importer and payable on arrival. These vary by country and we cannot calculate them in advance. Since the United States ended duty-free treatment for low-value imports, US recipients should expect a duty and a brokerage fee on physical items. We declare shipments accurately and cannot mark them as gifts or under-declare them. If a parcel is lost or damaged in transit we replace it at our cost.
Our liability
We are liable to you for foreseeable loss and damage caused by our breach of this contract or our failure to use reasonable care and skill. Except for the matters below, our total liability arising out of or in connection with your commission is limited to the amount you actually paid us for it. We are not liable for loss that is not foreseeable, for business losses, or for loss of profit, revenue, data or goodwill — and in particular we are not liable for the cost of applying, cutting, fabricating, removing or repairing the artwork on a vehicle or any other surface, for damage to paint, clear coat, glass, trim or wrap, for adhesive residue, or for any effect on your vehicle's value, warranty, insurance or roadworthiness. Where your commission includes a vector master, any cutting, printing, engraving or application by a workshop you choose is done under your own contract with that workshop; we supply clean, scalable files and a recommended size for your model and are not responsible for their workmanship, materials or results. You are responsible for checking that displaying the crest on your vehicle is permitted where it is registered and driven — several countries regulate decals and vehicle markings. Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, for any breach of your mandatory consumer rights, or for anything else that cannot lawfully be limited.
Your statutory rights
Nothing in these terms affects your legal rights as a consumer. The digital parts of your commission must be as described, fit for purpose and of satisfactory quality; if they are not, you are entitled to have them brought into conformity, or to a price reduction or refund where that is not possible. Physical items must be as described and of satisfactory quality; if they are not, you are entitled to repair, replacement, price reduction or refund. In the EU and the UK your legal guarantee runs for at least two years. The refinement rounds included in your tier are a feature of our service — they are additional to these rights and do not replace them.
Age
Commissions are offered only to individuals aged 18 or over who can enter into a binding contract. By ordering you confirm you are at least 18 and that any payment card or account used is yours or is used with the account holder's permission. We do not knowingly accept orders from, or collect personal data from, anyone under 18; if we learn an order was placed by a minor we may cancel it and refund the payment.
Circumstances beyond our control
We are based in Ukraine and work under wartime conditions. Air-raid alerts, power and internet outages, and disruption to postal and courier services can delay a commission. We will tell you promptly and give you a revised date. If a delay caused by an event outside our reasonable control exceeds 60 days, you may keep your place in the queue or cancel and receive a full refund of everything paid for the part not performed. This does not limit your statutory rights.
Complaints
If something is wrong, write to imobservercompany@gmail.com with "Complaint" in the subject line, or to our postal address above. We acknowledge every complaint within 2 working days and give a substantive reply within 14 days. We are not a member of any alternative dispute resolution scheme, which does not affect your right to bring proceedings. If you think an invoice is wrong or your commission was not delivered as agreed, please contact us before raising a chargeback — where you are owed a refund under our Refund policy we will pay it faster than any chargeback process will, and a dispute raised without contacting us is likely to be answered with the record of your brief, your written approvals and proof of delivery.
Changes to these terms
We may update these terms. The version that governs your commission is the one published on imobserver.com on the day you placed your order, identified by the date at the top of this page; we record which version you accepted and will send you a copy on request. Changes never apply retroactively to a commission already paid for.
Governing law
These terms are governed by the laws of Ukraine. This does not deprive you of the protection of mandatory provisions of the law of your own country or state of residence, and as a consumer you may bring proceedings in the courts of the country where you live. Before starting any proceeding, please email us a short description of the problem and what you would like us to do, and give us 60 days to put it right — almost everything is settled at that stage. These terms, together with your order, any invoice, your brief and our Privacy and Refund policies, are the whole agreement between us. If any provision turns out to be unenforceable, the rest stays in force. These terms are made in English; any translation is for convenience only.
